We haven't had a guns thread in a while gang!

Hey Doc, I think this was something we've talked about in the past. The Conn Supreme Court says the maker can be sued. Is this a back door to gun control? I will hang up and listen.

The lawsuit is DOA and this isn't some attempt to curb gun rights. This is long settled law and some judge looking to get attention.

edit: oh.. it's limited to the "wrongful marketing" portion of the suit. Snowflake.
The majority of the high court agreed with most of the lower court's ruling and dismissed most of the lawsuit's allegations, but allowed a wrongful marketing claim to proceed.

I haven't read the opinion but I think the "wrongful marketing" theory of liability is a stretch to say the least.

It's an attempt to circumvent the PLCAA to be sure by framing it as an unfair or deceptive trade practice under Connecticut consumer protection laws. What's interesting to me is that the court is allowing wrongful death and personal injury damages to be considered under the act.

Regardless, I'm not clear on whether the plaintiffs will have to prove that Lanza's mother bought the weapon because she was influenced by the advertising or if Lanza himself was influenced to use that particular weapon because of the advertising.
